This Privacy Policy (the “Policy”) applies to the websites, applications, and electronic communications on which it appears (the “Platform”). The Policy describes how Rails International, LLC as well as our affiliates and subsidiaries (collectively "Rails" or "we" or "us" or "our") uses the Personal Information that we collect, receive, maintain, and store about you. Please read this Privacy Policy carefully, by interacting with us through the Platform you consent to this Policy.
1. Types of Personal Information Collected
We collect a range of Personal Information. “Personal Information” is information that identifies, relates to, describes, or is reasonably capable of being associated with or linked to an individual. When we combine Personal Information with other information (i.e. information that does not, on its own, identify you), we treat the combined information as Personal Information.
Contact and Demographic Information – If you register for an account, sign up for our newsletter, submit an inquiry, or make a purchase we may collect your contact and mailing information. This may include your email name, address, and phone number. We may also collect your date of birth to verify your ability to purchase our products.
Payment Information – If you make a purchase through the Platform, we will collect your payment information such as, but not limited to, your credit card information, bank account information, and billing address. We will also collect your purchase details.
Employment Information – If you apply for employment with Rails, we will collect your employment and work history, as well as personal information related to your potential employment. This may include your education and employment history, address and contact information, demographic information, and any other information included in your resume or application.
Account Information – If you create an account with us, you will create and provide us with a user name and password, and may upload other personal information through our customer portal. We may also collect your purchase information.
Purchase and Preference Information – We may also collect your product preferences and service parameters, as well as your order and return history and preferences.
Location Data – While navigating our Platform your mobile device or browser may share your location data, both through WiFi and GPS. Rails will collect this information based on the settings of your phone and browser.
Usage Information – We may also collect usage and device information when you visit our Platform. This may include information about the browser, operating system, and/or device identifier for the device you are using, your ISP and IP information, your navigation activity on the Platform, as well as the websites that you came from and the site you visit when you leave.
Communication Information – We may collect Personal Information contained within your communications with us, including audio, electronic, or visual information, and any files provided to us via email, chat functionality, social media, telephone, or otherwise. Where permitted by applicable law, we may collect and maintain records of calls and chats with our agents, representatives, or employees via message, chat, post, or similar functionality.
2. Method of Information Collection
We collect personal information in a variety of ways. We collect information directly from you; for example, when you register an account on the Platform, make a purchase, submit a job application, or correspond with us through the Platform. We also collect information if you contact our customer service team.
We may also collect your personal information via cookies and pixels through the use of trusted third party partners. We also collect information from third parties. For example, we work with business partners, subcontractors in technical and delivery services, advertising networks, analytics providers, and search information providers.
We also collect information from you passively. Our Platform uses tracking tools like cookies, pixels, and beacons. We do this both on our Platform and in emails/SMS that we send to you. Through these tools we collect information about users over time when you use our Platform. This collection includes usage and browser information. We may also have third parties collect Personal Information in this way. For more information about the trackers that we use, please see Section 6 of this Policy. Additionally, if you enable location data on your device, this data will be collected passively based on the location settings on your device.
3. Combining Information
We may combine Personal Information we obtain. For example, we may combine information that we have collected online with information that we have collected offline, for instance during calls between you and our support team. We may also combine information that we have collected across other third-party sites or from other third party partners with information we already have. Our third party partners may combine your email information with other information they have access to for relevant marketing purposes. Finally, we combine information across devices.
4. How We Use Personal Information
We may use your Personal Information to process and fulfill your orders and purchases. We may also use your Personal Information to offer our services and respond to your requests and inquiries. We may also use your Personal Information to send you communications, including both transactional and marketing communications. For example, we might contact you about this Privacy Policy or our Terms & Conditions, as well as to send you our newsletter or make you aware of special offers available to you. If you participate in a contest, promotion, or sweepstakes that we sponsor or co-sponsor, we may contact you regarding that event.
We may also use your Personal Information to improve our Platform, products, and services. This may include using your information to customize your experience with us. We may also use your Personal Information for the security of the Platform and our company, our customers, and other third parties. We may also use your Personal Information to protect against fraud and other malicious activity. We may also use your Personal Information to provide you with customer service.
If you are applying for employment with us, we also use Personal Information to process your job application, to verify the information you have provided in your application, conduct interviews, perform background and reference checks, to communicate with you and answer your questions, to confirm your eligibility for employment, and improve our recruiting processes. We may also save your Personal Information for future employment opportunities with us.
We may also use your information for marketing purposes and share your Personal Information with third party marketing partners for their own marketing and commercial purposes. For example, we may send you information about new features on the Platform, new services we offer, and special offers. When legally permitted, this may also include using your information to serve you ads and to tell you about products or offers available through third parties we think you might find interesting. These might be our own offers, or third party offers, or products we think you might find interesting.

5. Disclosing Personal Information
We may disclose your Personal Information in the following circumstances:
- Within Rails – We may share your Personal Information within our family of companies.
- Service providers – When we hire a service provider to help operate the Platform or our business, we may give access to Personal Information as necessary to perform the service for Rails. This may include service providers that help us fulfill orders, process payment, reduce fraud, operate our Platform, send our communications, or run our promotions.
- Business Partners – Rails may share Personal Information to our trusted business partners. For example, we may share your Personal Information with a company when we co-sponsor a promotion or service. These partners may use your information to, among other things, send you information or contact you about their services and products.
- Third Parties for Marketing Purposes – We may share your Personal Information with third parties for their marketing purposes. This may include third parties whose services we believe you may be interested or who are interested in providing you with services. These third parties may share your information with others and may use this information for their own interest-based advertising.
- Legal obligation or protection from harm -When Rails has a good faith belief that access, use, preservation or disclosure of the Personal Information is reasonably necessary to (a) satisfy or comply with any requirement of law, regulation, legal process, or enforceable governmental request, (b) enforce or investigate a potential violation of the Terms of Use, (c) detect, prevent, or otherwise respond to fraud, security or technical concerns, (d) support auditing and compliance functions, or (e) protect the rights, property, or safety of Rails, its users, or the public against harm.
- Merger or sale -If and when Rails is involved in a merger, acquisition, or any form of transfer or sale of some or all of its business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding. Personal Information may be transferred along with the business. Where legally required we will give you prior notice and if you have a legal right to do so, an opportunity to object to this transfer.
- Purposes described to you – We may share your Personal Information for other purposes, as we describe to you.
6. Cookies and Other Technologies
We collect information about users over time on the Platform by using several common types of cookies and other tracking technologies including web beacons, pixels, and flash cookies. We also have third parties that collect information in this way on our behalf and for their own purposes. Cookies are small files that download when you access certain websites. 7. Your Email Marketing Choices
To opt-out of marketing communications and/or remove your personal information from our records, please email us at info@rails.com or by following the instructions included in the email or text correspondence. With respect to these requests, please include your current e-mail address and full name. Please note that, even if you unsubscribe from certain correspondences, we may still need to contact you with important transactional or administrative information, as permitted by law.
8. Children
The Platform is meant for adults and we will not knowingly collect personally identifiable information from any person under the age of 16 without permission from a parent or guardian. The Platform is not designed to attract the attention of persons under the age of 16. If you are a parent or legal guardian and think your child has given us information you can email us at info@rails.com. You can also write to us at the address listed in the “Contact Us” section of this Policy. Please mark your inquiries “COPPA Inquiry.”
9. Exercising Your Privacy Rights
Depending on where you live, you may have the following rights with respect to your Personal Information under applicable data protection laws:
• Access – The right to request access to and obtain a copy of any Personal Information we may have about you.
• Deletion – The right to delete your Personal Information that we have collected or obtained, subject to certain exceptions.
• Correction – The right to request that we correct any inaccuracies in your Personal Information, subject to certain exceptions.
• Opt Out of Certain Processing – The right to: (a) opt out of the processing of your Personal Information for purposes of targeted advertising, (b) opt out of the sale or sharing of your Personal Information; (c) limit the use of your sensitive Personal Information (if applicable), and (c) opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. We do not collect or process sensitive Personal Information outside of purposes permitted by law (such as section 7027(m) under the California Consumer Privacy Act Regulations), so we do not offer the option to limit its use. We also do not profile you or other individuals in a manner that would result in legal or similarly significant effects, so we do not offer an opt out.
• Objection/Restriction of Processing – The right to object or restrict us from processing your Personal Information in certain circumstances.
• Withdraw Consent – The right to withdraw your consent where we are relying on your consent to process your Personal Information.
• Automated Decision-Making – The right to know when you are subject to automated decision-making, the Personal Information used to render the decision, the principal factors and parameters involved in the decision, and human review or correction of the decision (or its underlying data, where appropriate). You may also have the right to consent or opt out of this automated decision-making, depending on your location.
• Lodge a Complaint – The right to lodge a complaint with a supervisory authority or other regulatory agency if you believe we have violated any of the rights afforded to you under applicable data protection laws. We encourage you to first reach out to us so we have an opportunity to address your concerns directly before you do so.

You may also exercise your opt out rights by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC). We honor Opt-Out Preference Signals, including GPC. If you choose to use an Opt-Out Preference Signal, you will need to turn it on for each supported browser or browser extension you use.
You will not be discriminated against in any way by virtue of your exercise of the rights listed in this Privacy Policy. However, should you withdraw your consent or object to processing of your Personal Information, or if you choose not to provide certain Personal Information, we may be unable to provide some, or all, of our services to you.
Only you, or an authorized agent that you authorize to act on your behalf, may make a request related to your Personal Information. We must verify your identity before fulfilling your requests, and if we cannot verify your identity, we may request additional information from you. If you are an authorized agent making a request on behalf of another person, we will also need to verify your identity, which may require proof of your written authorization or evidence of a power of attorney. We endeavor to respond to requests within the time period required by applicable law. If we require more time, we will inform you of the reason and extension period in writing.
We do not charge a fee to process or respond to your requests unless they are excessive or repetitive. If we determine that a request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We may deny certain requests, or only fulfill some in part, as permitted or required by law. If you are not satisfied with the resolution of your request and you are afforded a right to appeal such decision, you will be notified of our appeal process in our response to your request.

This section provides additional information regarding Rail’s practices pursuant to the California Consumer Privacy Act of 2018 and its implementing regulations, as amended by the California Privacy Rights Act (“CCPA”), where “Personal Information” has the definition set forth in the CCPA.

California Shine the Light – Under California Civil Code Section 1798.83, individual customers who reside in California and who have an existing business relationship with us may request information about our disclosure of certain categories of Personal Information to third parties for the third parties’ direct marketing purposes, if any. This request may be made no more than once per calendar year.
10. Information for Individuals in the EU
This section provides additional information regarding Rails’ processing of personal data of people located in the European Union (“EU”), European Economic Area (“EEA”), Switzerland, and the United Kingdom (“UK”) in accordance with the EU Data Protection Regulation, UK Data Protection Regulation, and the Swiss Federal Data Protection Act.
Our legal basis for collecting and using the Personal Information described in this Privacy Policy will depend on the Personal Information concerned and the context in which we collect it. We collect Personal Information from you:
- where we need it to perform a contract with you;
- where the processing is in our legitimate interests (including the purposes described, above, in How We Use Personal Information);
- where the processing is necessary for us to meet our applicable legal obligations; or
- if we otherwise have your consent.
Personal Data that we collect or receive may be transferred to and/or processed by third parties that are located outside of the EU, EEA, UK, or Switzerland, some of which applicable authorities may not consider to have an adequate level of protection for Personal Data. Rails will only transfer Personal Data to third parties located outside of the EU, EEA, UK, or Switzerland when it has ensured appropriate safeguards for such Personal Data through use of the standard contractual clauses or other lawful and approved methods.

10. Information for Individuals in Canada
We comply with applicable Canadian data protection laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA).
Your provision of Personal Information to us means that you agree that we may collect, use and disclose such Personal Information for the purposes described in this Privacy Policy. Should you choose not to provide us with required Personal Information, we may not be able to provide certain services. You acknowledge that we may retain service providers to perform certain services, and that such service providers may be located in the United States or another jurisdiction. You further acknowledge and agree that Personal Information may be processed and stored in such jurisdiction, and that foreign courts or law enforcement or regulatory agencies may be able to obtain disclosure of such Personal Information in such jurisdictions.
Depending in which province you reside, you may have the privacy rights set forth above, including the rights to access, delete, and request correction of your Personal Information.
When we rely on your consent, you may have the right to refuse to provide or to withdraw your consent to processing of your Personal Information at any time. This would not affect processing where applicable law allows us to process Personal Information without consent.
We will not collect, use or disclose your Personal Information for any other purpose than those outlined above, except with your consent. We will respond to your requests regarding your Personal Information as promptly as possible.
11. Storage, Security and Retention of Information
Rails has taken reasonable steps to protect the information users share with us, including, but not limited to, setup of processes, equipment and software to avoid unauthorized access or disclosure of this information. No transmission of information via the Internet can be entirely secure, however, so please always use caution when submitting Personal Information.
We store information both inside and outside the United States. If you live outside of the United States, be advised that we may transfer and store your information to the United States. US law may not provide the same protections as the laws in your country. By providing us with your Personal Information you agree to the processing of it in the United States as permitted by US law. Information transferred from the EU will be subject to the appropriate safeguards pursuant to GDPR and other applicable law.
We will retain each category of your Personal Information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless otherwise required by applicable laws. Criteria we will use to determine how long we will retain your Personal Information include whether we need your Personal Information to provide you with the services you have requested; we continue to have a relationship with you; you have requested information or services from us; we have a legal right or obligation to continue to retain your Personal Information; we have an obligation to a third party that involves your Personal Information; our retention or recordkeeping policies and obligations dictate that we retain your Personal Information; we have an interest in providing you with information about our services; or we have another business purpose for retaining your Personal Information.

Our Platform may include third party content and links to third party websites and services that collect Personal Information. We do not endorse or control these third parties and this Privacy Policy does not apply to their privacy practices. We are not responsible for the practices of these third parties or how they use information you provide to them. Please read the third parties’ privacy policies carefully.
We work with Epsilon Abacus (registered as Epsilon International UK Ltd), a company that manages the Abacus Alliance on behalf of UK retailers. The participating retailers are active in the clothing, collectables, food & wine, gardening, gadgets & entertainment, health & beauty, household goods, and home interiors categories. Retailers share information about their customers and what they buy. Epsilon Abacus processes this information as a processor on behalf of the retailers to help them understand consumers’ wider buying patterns. From this information, retailers can tailor their communications, sending individuals suitable offers that should be of interest to them, based on what they like to buy.
